Section 1Welcome to Junior Primary School. By accessing or using our website, services, or enrolling your child, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
Important Notice
These Terms constitute a legally binding agreement between you and Junior Primary School. If you do not agree with any part of these Terms, you must not use our website or services.
Your access to and use of our services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, parents, guardians, and others who access or use our services.

By creating an account, enrolling a student, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.2 Updates to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting notice on our website or sending you an email. Your continued use after such modifications constitutes your acceptance of the updated Terms.
Definitions
Section 2For the purpose of these Terms, the following definitions apply:
"School"
Junior Primary School, its staff, administrators, and authorized representatives
"User"
Any person accessing our website, including parents, guardians, and visitors
"Student"
A child enrolled in or applying to Junior Primary School
"Content"
All text, images, videos, documents, and materials on our website
"Services"
All educational, administrative, and online services provided by the School
"Agreement"
The enrollment contract between parents and the School
Eligibility
Section 3By using our services, you represent and warrant that:
- You are at least 18 years of age and have the legal capacity to enter into binding agreements
- You are the parent or legal guardian of any student you enroll or for whom you submit information
- All information you provide is accurate, current, and complete
- You will maintain the security of your account credentials
- Your use of our services complies with all applicable laws and regulations
Minor Students
Our services are intended for use by parents and guardians on behalf of minor students. We do not knowingly collect information directly from children under 13 without parental consent.
User Obligations
Section 4As a user of our services, you agree to:
Provide Accurate Information
Submit true, accurate, and complete information in all applications and communications
Maintain Confidentiality
Keep your login credentials secure and notify us of unauthorized access
Timely Payments
Pay all fees when due as outlined in the fee structure
Respectful Communication
Communicate respectfully with staff, teachers, and other parents
Comply with Policies
Follow all school policies, including code of conduct and safety guidelines
Report Concerns
Promptly report any concerns about student safety or well-being
Prohibited Activities
Section 5You agree not to engage in any of the following prohibited activities:
- Unauthorized Access: Attempting to gain unauthorized access to our systems or other users' accounts
- Harassment: Harassing, intimidating, or threatening staff, students, or other parents
- False Information: Providing false or misleading information in applications or communications
- Copyright Infringement: Copying, distributing, or using our content without permission
- Malicious Code: Introducing viruses, malware, or other harmful code
- Data Mining: Scraping or extracting data from our website without authorization
- Disruption: Interfering with the proper functioning of our website or services
- Impersonation: Impersonating another person or entity
Consequences
Violation of these prohibitions may result in immediate termination of access, legal action, and reporting to appropriate authorities.
Fees & Payments
Section 6By enrolling a student, you agree to pay all applicable fees as outlined in the current fee structure.

6.2 Payment Terms
- Due Dates: Fees are due on the first day of each term unless otherwise arranged
- Late Payments: A late fee of 5% per month will be applied to overdue balances
- Payment Methods: Bank transfer, M-Pesa, or check payable to Junior Primary School
- Receipts: Official receipts will be provided for all payments
6.3 Refund Policy
- Application Fee: Non-refundable under any circumstances
- Enrollment Fee: 50% refundable if withdrawal occurs before term start
- Tuition: Pro-rated refund if student withdraws within first 4 weeks of term
- No Refunds: After 4 weeks of term, no tuition refunds
- Special Circumstances: Medical or relocation cases considered on individual basis
Financial Assistance
Limited scholarships and payment plans are available for qualifying families. Contact our finance office for more information.
Intellectual Property
Section 7All content on our website and materials provided by the School are protected by intellectual property laws.
7.1 School Property
The School owns or licenses all content, including but not limited to:
- Curriculum materials, lesson plans, and educational resources
- Website design, code, and graphics
- Logos, trademarks, and brand elements
- Photographs and videos of school facilities and events
- Written content, articles, and publications
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
- Access and view our website for personal, non-commercial use
- Download and print materials for personal educational use
- Share links to our content with attribution
7.3 Prohibited Uses
You may not:
- Reproduce, distribute, or publicly display our content without written permission
- Use our trademarks or logos without authorization
- Sell or commercially exploit our materials
- Remove copyright or proprietary notices
7.4 User-Generated Content
By submitting content (such as comments, photos, or testimonials), you grant the School a non-exclusive, royalty-free license to use, reproduce, and display such content for school-related purposes.
Termination of Services
Section 8Termination by School
The School may terminate or suspend access to services immediately, without prior notice, for:
- Violation of these Terms
- Non-payment of fees
- Behavior that endangers students or staff
- Providing false information
- Legal or regulatory requirements
Termination by Parent
Parents may terminate enrollment by:
- Providing written notice of withdrawal
- Settling all outstanding fees
- Returning school property
- Completing exit procedures
8.1 Effect of Termination
Upon termination:
- Your right to access services immediately ceases
- Outstanding fees remain due and payable
- Student records will be transferred to new school upon request
- Sections regarding liability, indemnification, and dispute resolution survive termination
Limitation of Liability
Section 9To the maximum extent permitted by law:

Maximum Liability
In any case, the School's total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.
Indemnification
Section 10You agree to indemnify, defend, and hold harmless Junior Primary School, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:
- Your access to or use of our services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or post
- Your conduct or the conduct of your child
The School reserves the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.

Section 11We value our relationship with parents and families and prefer to resolve disputes amicably.

Arbitration
Binding arbitration in Nairobi
11.2 Arbitration
Any dispute not resolved through mediation shall be settled by binding arbitration in accordance with the Nairobi Centre for International Arbitration (NCIA) rules. The arbitration shall be conducted in Nairobi, Kenya, in English.
11.3 Class Action Waiver
You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.
Governing Law
Section 12Laws of the Republic of Kenya
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. The courts of Kenya shall have exclusive jurisdiction over any disputes not subject to arbitration.
Applicable Laws Include:
- The Constitution of Kenya (2010)
- The Basic Education Act (2013)
- The Children Act (2022)
- The Data Protection Act (2019)
- The Consumer Protection Act (2012)
Changes to Terms
Section 13We reserve the right to modify these Terms at any time. When we do, we will:
- Update the "Last Updated" date at the top of this page
- Notify enrolled families via email or parent portal
- Post a prominent notice on our website for 30 days
- Provide a summary of changes
Your continued use of our services after any changes constitutes your acceptance of the new Terms.

14.1 Notice of Claim
Any legal notice or claim must be sent to our registered address with a copy to legal@juniorprimaryschool.com. Notices are deemed received 3 business days after sending.
